Accessing medical records

Individuals are able to access their own. In some cases certain third parties have the right to ask for copies of medical records.

For living individuals, access to medical records is generally made under the Data Protection Act 1998.
For deceased individuals (where the record was created after 1991), access to medical records is generally via Access to Health Records Act 1990. If the records were created before 1991 then access is made under the Freedom of Information Act 2000.

As a Trust we take the security and confidentiality of our patient information very seriously, which is why we ask for two forms of identification before we will release medical records.

Caldicott Guardian

If you have any queries relating to the processing of your medical information, you can contact the Trust’s Caldicott Guardian, who has responsibility to ensure the protection of patient confidentiality throughout the Trust in accordance with your legal rights.
